Pursuant to this Court’s order dated 23.07.2026 wherein by such order the accused person in question has been enlarged on interim bail, the learned counsel for the petitioner has submitted at the bar that the survivor and the accused person are now residing together as husband and wife and under such circumstances it is prayed that the interim bail may be made absolute with any conditions to be imposed by this Court. 2. Mr. G.J. Nongphud, learned counsel for the complainant/respondent No. 3 has also concur with such submission and has no objection if bail is granted. 3. Similarly, Mr. A.S. Dey, learned GA appearing for the respondent Nos. 1 and 2, in his submission has fairly conceded that under the peculiar facts and circumstances of this case, the relationship between the accused person and the survivor being cordial and consensual, as far as the prayer for bail is concerned no objection is hereby made. 4. The learned GA has also produced the case diary before this Court as called for. 5. This Court has considered the submission made and as has been 2026:MLHC:854 3 submitted because of the relationship between the accused and the survivor, the merits of the case to be looked into at the time of trial, however for the purpose of bail, this Court is inclined to allow the prayer made. 6. Accordingly, the interim bail granted is hereby made absolute. The accused person is now released on bail on the following conditions: i. That he shall not abscond or tamper with the evidence or witnesses; ii. That he shall appear before the IO as and when called for; iii. That he shall not leave the jurisdiction of Meghalaya during pendency of investigation or trial without prior permission from the concerned IO or the court, if it comes to that; and iv. That he shall bind himself on a personal bond of ₹ 20,000/- (Rupees Twenty Thousand) only with one surety of like amount to the satisfaction of the competent court of jurisdiction. 7.
