Side) PETITION FOR BAIL Under Sec.483 of BNSS PRAYER :- For Bail in Cr.No. 814 of 2026 on the file of the respondent police. ORDER : The Court made the following order :- The petitioner / Accused, who was arrested and remanded to judicial custody on 23.07.2026, for the offences punishable under Section 3 of TNPPDL Act, in Crime No.814 of 2026 on the file of the respondent police, 1/6 https://www.mhc.tn.gov.in/judis Crl.O.P.(MD)No.16689 of 2026 seeks bail. 2. . The allegation against the petitioner is that this petitioner has damaged the windshields of two lorries parked at the workshop for repair, SIM and Memory cards also stolen. The estimated value of the damaged property is Rs.20,000/-. Knowing the involvement of the petitioner, he was arrested. 3.The learned counsel for the petitioner submitted that there is no eye witness to the occurrence. He has been falsely implicated in this case. He is in custody from 23.07.2026 and he is ready co-operate with the investigation. Hence, he prayed for grant of bail to the petitioner. 4.The learned Counsel for the State of TN (Crl. Side) appearing for the respondent Police submitted that the value of the property assessed as Rs.20,000/- and investigation is not yet concluded. The petitioner has three previous cases. Hence, he strongly opposed to grant bail to the petitioner. 5.Heard the learned counsel on either sides and perused the materials available on records. 2/6 https://www.mhc.tn.gov.in/judis Crl.O.P.(MD)No.16689 of 2026 6.Considering the nature of allegation and though the petitioner has three previous cases, they are under TNPPDL Act and 323 IPC, that it is no case of injury and also considering the period of incarceration this Court is inclined to grant bail to the petitioner on condition of payment. [a] Accordingly, this Criminal Original Petition is allowed on condition that the petitioners shall deposit a sum of Rs.10,000/- (Rupees Ten Thousand only) to the credit of Cr.No.814 of 2026 before the trial Court concerned, without prejudice to his rights and contentions before the trial Court. [b] On such deposit being made, the petitioner is ordered to be released on bail on condition to execute a bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.V, Tirunelveli, and on further conditions that: [c] he petitioner shall report before the respondent police, daily at 10.30 a.m., for a period of three weeks, thereafter as and when required for interrogation; [d] the petitioner shall not commit any offence similar to the offence of which he/she is accused, or suspected, or of the commission of which he/she is suspected; 3/6 https://www.mhc.tn.gov.in/judis Crl.O.P.(MD)No.16689 of 2026 [e] the petitioner shall not abscond either during investigation or trial; [f] the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade her from disclosing such facts to the Court or to any police officer or tamper with the evidence; [g] On breach of any of the aforesaid conditions, the learned Judicial Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 51730]. [h] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
