Mr. Chitrarth Kandpal, learned Brief Holder, for the State of Uttarakhand. 3. In the High Court of Uttarakhand, the present case arises from Bail Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail for the Applicant – Gautam Singh Danu, who has been accused in Case Crime No.34 of 2026, under Sections 8/20 of the Narcotic Drugs and Psychotropic Substances Act, at Police Station Kotwali Pithoragarh, District Pithoragarh. 4. As per the prosecution case that on 25.03.2026, when the Police officials are on routine checking, they saw a bike in which two persons were sitting, they seemed to be a bit nervous when the police suddenly stopped them, and there has been recovery of the contraband, namely, Charas, from them. 5. Learned counsel for the Applicant submits that the Applicant has falsely been implicated in the present matter. She further submits that there has been non compliance of the mandatory provisions of the NDPS Act. It is also contended by the learned counsel for the Applicant that the Applicant is only aged about 18 years and studying in Class 11th. 6. Learned State Counsel has vehemently opposed the bail application of the Applicant on the ground that alleged contraband recovered from the possession of the Applicant is of commercial quantity i.e. 2 Kg charas, and prays that the Applicant may not be enlarged on bail. 7. Considering the overall facts and circumstances of the case, this is not a fit case for bail. Consequently, the bail application of the Applicant – Gautam Singh Danu, is hereby rejected in connection with the Case Crime No.34 of 2026, under Sections 8/20 of the Narcotic Drugs and Psychotorpic Substances Act, at Police Station Kotwali Pithoragarh, District Pithoragarh.
