2. Petitioner is enrolled as Jawan in Prantiya Rakshak Dal (PRD). Earlier he was posted in Primary Health Centre, Laldhang, District Haridwar. He filed Writ Petition (M/S) No. 2241 of 2025, expressing his desire to serve in 220, KV operation and maintenance Division of Piran Kaliyar, Haridwar. The said writ petition was disposed of with liberty to petitioner to make representation regarding his posting.
3. Pursuant to the order passed by this Court, respondent No. 2 has passed an order on 12.02.2026, whereby the request made by petitioner for posting at Piran Kaliyar was turned down.
4. Petitioner has sought quashing of the said
order, and he has also sought a writ of mandamus to the competent authority to again consider his case for posting at Piran Kaliyar.
5. Learned State Counsel submits that as an outsourced employee, petitioner cannot decide
2026:UHC:3544 where he has to be posted and it is for the competent authority to pass order of posting in respect of PRD Jawans.
6. He thus submits that order impugned passed by respondent No. 2 cannot be faulted.
7. This Court finds substance in the submission made by learned State Counsel.
8. As an outsourced employee, petitioner cannot dictate terms to his employer as to where can be posted. However, having regard to the peculiar facts of the case, the writ petition is
disposed of with a request to the competent authority to consider if petitioner can be posted at a place other than Laldhang in District Haridwar.
