This bail application has been filed on behalf of Pawan Kumar Rawani who is in custody since 15.09.2025 in connection with Pachamba P.S. Case No. 103 of 2025 for the offence registered under Sections 69 and 351(3) of BNS, 2023 pending in the Court of learned CJM, Giridih, is pressed into motion. It is submitted by the learned counsel on behalf of petitioner that victim girl is aged 29 years old divorcee and alleged incident took place in 2021, whereas FIR has been lodged in 2025. There is no material to show that there was any protest or resistance on the part of victim to the consensual physical relationship which continued for four years allegedly on a false promise of marriage. Learned A.P.P. for the State opposed the prayer for bail. Considering the delay in lodging the FIR, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty- Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
