For Petitioner : Mr.P.Dinesh Kumar For Respondents : Mr.L.Siva Government Advocate (Civil) 1/5 https://www.mhc.tn.gov.in/judis W.P(MD)No.23046 of 2026 ORDER The writ petition is filed seeking issuance of writ of mandamus directing the second respondent to issue patta in favour of petitioner and her siblings in respect of the property comprised in S.No.193/1 with an extent of 80 ares situated in Reddiyarpatti Village, Palayamkottai Taluk, Tirunelveli District, by considering petitioner's online application dated 19.05.2026. 2.Heard the arguments of Mr.P.Dinesh Kumar, learned counsel for the petitioner and Mr.L.Siva, Government Advocate (Civil), who takes notice on behalf of the respondents. By consent, this writ petition is taken up for final disposal at the admission stage itself. 3.It is the case of the petitioner that the subject property was purchased by her paternal grandfather Muthu Reddiyar, who died on 24.06.1975 leaving behind the petitioner's father, Balakrishnan and five others as his legal heirs. The petitioner's father, Balakrishnan, died on 12.07.2016 leaving behind the petitioner and her siblings as his legal heirs. According to the petitioner, she and her siblings inherited the subject property and instant application has been filed seeking issuance of patta. 2/5 https://www.mhc.tn.gov.in/judis W.P(MD)No.23046 of 2026 4.Even as per the case of the petitioner, the subject property originally belonged to Muthu Reddiyar, her grandfather. However, after his demise, it is not known as to how the petitioner's father, Balakrishnan, acquired exclusively right over the subject property. In such circumstances, all the legal heirs of Muthu Reddiyar would be entitled to claim a right over the subject property. In view of the same, this Court is not inclined to issue any positive direction as prayed for in the writ petition. 5.However, the second respondent is directed to consider the online application filed by the petitioner on 19.05.2026 and pass appropriate orders in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner, her siblings and all the legal heirs of Muthu Reddiyar. 6.The petitioner is directed to furnish the details of all the legal heirs of Muthu Reddiyar and her siblings along with their correct addresses within a period of two weeks from today (i.e., 11.08.2026).
