W.P.(MD)No.23047 of 2026 Karaikudi Taluk, by considering the application of the petitioner dated 11.05.2026 and the report of the 3rd Respondent dated 23.06.2026. 2. It is the case of the petitioner that Kottaiyur Naattars Trust originally owned 62.30 ares of land in the above mentioned survey number. Out of the total extent, an extent of 38.70 acres was sold to a private firm called 'Karpaga Vinayagar Firm', as per the due order passed by the Court, to settle the outstanding tax arrears. The remaining extent of 23.60 acres was retained by the above mentioned trust.
It is also stated by the petitioner that due to internal dispute among Kottaiyur Naattars, with regard to the management of Trust properties, a suit was filed in O.S.No.72 of 1933, on the file of Sub Court, Devakottai and a Receiver was appointed to manage the Trust properties. However, at the time of mutation of revenue records, the entire extent of the land was recorded in the name of 6th respondent College Trust, taking advantage of absence of the Receiver, who died. Therefore, the petitioner as an interested person submitted a representation before the official respondents seeking sub-division of the property retained by the trust and issuance of patta in the name of, the Receiver, Kottaiyur Naattars Trust. The learned Special Government Pleader appearing for the respondents 1 to 5 would submit that based on the representation submitted by the petitioner, the survey of the subject property has been done and now the enquiry is posted on 18.08.2026. 4. The learned counsel appearing for the 6th respondent would submit that he has no objection for sub-dividing the 23.60 acres of land retained by Kottaiyur Naattars Trust and issuance of patta in the name of the said Trust. The said statement is recorded. 5. In the light of the concession made by the learned counsel appearing for the 6th respondent, the scope of the pending enquiry on the file of the second respondent has got reduced. Therefore, taking into consideration that already date is fixed for enquiry, this Court, without expressing any opinion on the merits of the matter, directs the second respondent to complete the enquiry and pass final orders on it's own merits, within a period of six weeks from the date of uploading of the copy of this order. 4/6 https://www.mhc.tn.gov.in/judis
