According to the petitioner, the said Temple is situated on Government Poramboke land. Reference is made to the ‘A’ Register, wherein the land comprised in S.No.447/25 is classified as Government Natham Poramboke. 3. It is submitted that the private respondents herein are excluding the petitioner and other villagers from the affairs of the Temple and, therefore, the petitioner submitted a representation dated 20.07.2026 to the second respondent/Revenue Divisional Officer. The learned Additional Government Pleader appearing for the official respondents submits that the Temple is outside the purview of the H.R. & C.E. Department and that, based on the representations submitted by the petitioner and the private respondents, a Peace Committee Meeting was held on 04.08.2026 in connection with the Kumbabhishekam of the said Temple, which is scheduled to be held on 23.08.2026, wherein the following decision was taken:- https://www.mhc.tn.gov.in/judis WP(MD) No. 23163 of 2026 __________ Page5 of 8 5. The learned counsel appearing for the private respondents submits that the Temple has been in existence for a very long period and is of considerable antiquity. It is further submitted that the petitioner belongs to the Surankoduthan Pangaligal, consisting of 25 families, and that their family deity [Kulatheivam] is Veilkatha Amman, situated at Pearali Village, Virudhunagar District. It is submitted that they are paying the tax [Thalaikattu Vari] and participating in the festivals of the said Temple, particularly, the Mahasivarathri festival. 6. It is submitted that, insofar as the private respondents are concerned, they belong to the Kenthampatti Pangaligal Vagayara, consisting of 150 families, who offer prayers to the said Temple as their family deity and have a Kovil Veedu. 7. It is further submitted that, in connection with the proposed Kumbabhishekam, the old idols of Ramar and Alagunatchi Amman are proposed to be replaced and that the petitioner is attempting to stall the proceedings by contending that he should also be permitted to contribute towards the tax [Thalaikattu Vari]. 8. The learned counsel for the private respondents has no objection to the petitioner making donations. However, it is submitted that the tax [Thalaikattu Vari] is to be confined to the 150 families belonging to various Villages in Madurai District. https://www.mhc.tn.gov.in/judis WP(MD) No. 23163 of 2026 __________ Page6 of 8 9. It is further submitted that the devotees of the said Temple, namely, the said 150 families, had migrated from Kenthampatti Village near T.Kallupatti, Madurai District, and that the said Temple belongs exclusively to the Kenthampatti Pangaligal. 10. Having considered the submissions made by the learned counsel for the petitioner, the learned Additional Government Pleader appearing for the official respondents and the learned counsel appearing for the private respondents, I am of the view that the proposed Kumbabhishekam scheduled to be held on 23.08.2026 cannot be allowed to be jeopardised on account of the dispute raised by the petitioner. If the petitioner claims any right to contribute towards the tax [Thalaikattu Vari] and to participate in the management of the said Temple, it is open to the petitioner to work out his remedy before the competent Civil Court. However, no Idol shall be installed without proper determination of the rights of the devotees before an appropriate forum. 11. The Writ Petition stands disposed of with liberty to the petitioner to make donations to the Management of the Temple in connection with the Temple festival.
