The petitioner is apprehending his arrest in connection with Khunti (Mahila) P.S. Case No. 16 of 2025, registered for the offence under Sections 69 and 89 of Bhartiya Nyaya Sanhita, 2023, pending in the Court of learned Chief Judicial Magistrate, Khunti. 3. Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in the case and they were in relationship since 27th September, 2017. He next submits that in between they have met several times and lastly, they have met in the year 2022. Thereafter, the present FIR has been lodged on 11.12.2025. 4. Learned A.P.P. appearing for the State as well as learned counsel for the informant have jointly opposed the prayer and submits that the allegations are thereof establishing relationship on false pretext of marriage. 5. Looking to the contents of the FIR, it transpires that the petitioner and informant were in relationship since September, 2017 and on several occasions, they have met at different places and even for some time, the informant has resided along with the petitioner in his village. Prima facie, it appears what has happened, that was consensual in nature. Even the allegation of miscarriage is of the year 2023, wherein the FIR has been lodged on 11.12.2025. In the attending facts and circumstances, the petitioner, named above, is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
