ORDER The present petition has been filed by the defacto complainant in Crime No.18 of 2025 on the file of the third respondent seeking transfer of the investigation to the fourth respondent.
2. According to the learned counsel appearing for the petitioner, despite a complaint lodged before the concerned police station, FIR was not registered and therefore, he was constrained to file Cr.M.P.No.377 of 2025 before the learned Judicial Magistrate No.II, Sivagangai, under Section 175(3) of BNSS, seeking registration of FIR. An order came to be passed on 16.06.2025 directing the respondent official to register an FIR. Pursuant to the said order, FIR was registered in Crime No.18 of 2025 on 10.09.2025.
3. The grievance of the petitioner is that so far no progress has been made in the investigation despite the fact that the alleged misappropriation 2/5 https://www.mhc.tn.gov.in/judis
Crl.O.P.(MD).No.16965 of 2026 has been accepted by the respondent police officials while filing a report before the concerned Judicial Magistrate as a counter to Section 156(3) of Cr.P.C application filed by the petitioner.
4. According to the learned counsel appearing for the petitioner, none of the accused persons have been arrested. However, the learned Government Advocate (Crl.Side) appearing for the respondents submitted that the accused have got anticipatory bail and in such circumstances, they are not able to arrest the accused persons.
5. Considering the fact that there is a delay in filing of the final report which has triggered the filing of the present application, there shall be a direction to the third respondent to file a final report within a period of two months from the date of receipt of a copy of this order.
6. With the above said observation, this Criminal Original Petition is
