...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased topleased to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the respondents in not releasing the bill amounts admittedly due to the petitioner, despite the successful completion of the works entrusted to him. The said works are duly (i) Providing quarry rubbish and selected earth to road from Nallagorla Brahmaiah House to Bhavirisetty Venkateswara rao Site in Amaravati Village and mandal covered by M-Book No. 343-B/MPDO/MPP/2023-24 for Rs. 1,88,440/- and (ii) Providing quarry rubbish and selected earth to road from Bhavirisetty Venkateswara rao House to Chinka Ramesh Site in Amaravati Village and Mandal covered by M-Book No. 343-B/MPDO/MPP/2023-24 for Rs.2,05,064 total aggregating to Rs.3,93,504/-, despite completion of the works and acceptance of the measurements and bills, as illegal, arbitrary, discriminatory, violative of Articles 14, 21 and 300-A of the Constitution of India, and consequently direct the respondents to forthwith release the said amount of Rs.3,93,504/-together with interest thereon from the date of completion of the works till realization and pass IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct the Respondents, to release the admitted amount of Rs.

This Writ Petition is filed seeking the following relief:
“...to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the respondents in not releasing the bill amounts admittedly due to the petitioner, despite the successful completion of the works entrusted to him. The said works are duly (i) Providing quarry rubbish and selected earth to road from Nallagorla Brahmaiah House to Bhavirisetty Venkateswara rao Site in Amaravati Village and mandal covered by M-Book No.343- B/MPDO/MPP/2023-24 for Rs.1,88,440/- and (ii) Providing quarry rubbish and selected earth to road from Bhavirisetty Venkateswara rao House to Chinka Ramesh Site in Amaravati Village and Mandal covered by M-Book No.343-B/MPDO/MPP/2023-24 for Rs.2,05,064 total aggregating to Rs.3,93,504/-, despite completion of the works and acceptance of the measurements and bills, as illegal, arbitrary, discriminatory, violative of Articles 14, 21 and 300-A of the Constitution of India, and consequently direct the respondents to forthwith release the said amount of Rs.3,93,504/- together with interest thereon from the date of completion of the works till realization and pass such other

2. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Panchayat Raj and Rural Development.
3. The petitioner’s Group executed two GGMP works relating to providing quarry rubbish and selected earth to roads in Amaravati Village and Mandal, with a total admitted bill amount of Rs.3,93,504/-. The works were completed within the stipulated time, the measurements were recorded in the M-Book,

and the final bills were sanctioned under the works of the year 2023-24 and in that regard Rc.No.01/2023-A dated 03.04.2024 was issued by Mandal Parishad Development Officer i.e., 7th respondent. Despite completion of the works and repeated representations, the respondents failed to release the admitted amount of Rs.3,93,504/-. It is the case of the petitioner that it borrowed money on interest to execute the work and is suffering serious financial hardship due to non-payment of admitted bill amount.

It is the grievance of the petitioner that notwithstanding the completion of the work and its measurement by the competent authorities, the amount due towards the executed work has not been paid till date. According to the petitioner, although the work was completed more than a year ago, the respondent authorities have not released the admitted amount payable to it. Aggrieved by the non-payment of the said amount, the petitioner filed the present Writ Petition.

Learned Assistant Government Pleader, on written instructions dated 13.07.2026, from the Mandal Parishad Development Officer - 7th respondent, submits that there is no dispute with regard to the execution of the work. According to him, the petitioner is entitled to an amount of Rs.3,93,504/- and that 7th respondent will pay the amounts on availability of general funds, and six months’ time is sought for payment of the said amount. The written instructions are placed on record.

6. Having regard to the fact that there is no dispute with regard to the work executed by the petitioner and the amount payable to him, and in view of the
submissions of the learned Assistant Government Pleader, the respondent authorities are directed to pay a sum of Rs.3,93,504/- (Rupees three lakhs ninety-three thousand five hundred and four only) to the petitioner within a period of six (06) weeks from the date of receipt of a copy of this order.
7. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
