Side) For R4 Order This writ petition has been filed seeking to direct the respondents 2 and 3 to survey and point out the field boundaries by fixing the boundary stones of petitioner’s property comprised in S.F. No.235/4 at measuring to an extent of 00179 sq. meter situated at Eraiyur Village, Ulundurpet Taluk, Kallakurichi District with 4th respondent’s Police aid for fencing in pursuance of petitioner’s online application vide No.2026/ N123/ 33/ 001170 dated 23.07.2026. 2.Learned counsel for the petitioner would submit that the petitioner made an online application dated 23.07.2026 seeking to survey and point out the field boundaries by fixing the boundary stones of petitioner’s property comprised in S.F. No.235/4 at measuring to an extent of 00179 sq. meter __________ Page2 of 6 https://www.mhc.tn.gov.in/judis WP No. 30945 of 2026 situated at Eraiyur Village, Ulundurpet Taluk, Kallakurichi District. Since the same was not considered by the respondents 1 to 3, the present writ petition has been filed. 3.Ms.R.K.Varshini, learned Government Advocate accepts notice on behalf of the respondents 1 to 3 and Mr.Durai Gunasekaran, learned Government's Counsel (Crl. Side) accepts notice on behalf of 4th respondent. 4.Learned Additional Government Pleader appearing for respondents 1 to 3 would submit that the petitioner’s online application dated 23.07.2026 will be considered and disposed of within a time frame to be fixed by this Court. 5.Heard the learned counsel for the petitioner; the learned Additional Government Pleader appearing for the respondents 1 to 3 and learned Government's Counsel (Crl. Side) appearing for the 4th respondent. 6.Considering the submissions made by both parties and in view of the limited prayer sought for in this writ petition, this Court without expressing any opinion on the merits of the case, directs the respondents 2 and 3 to consider the petitioner’s online application dated 23.07.2026 and conduct a survey and demarcate the subject property, within a period of six (6) weeks from the date of receipt of a copy of this order, after issuing prior notice to the petitioner and the __________ Page3 of 6 https://www.mhc.tn.gov.in/judis WP No. 30945 of 2026 5th respondent and other parties concerned, if any. If any need arises for Police assistance, it is open to the respondents 2 and 3 to request for Police protection from the 4th respondent/jurisdictional Police. If any such request is made, the 4th respondent/jurisdictional Police is directed to provide an adequate Police protection for conducting the survey. As for as the request made with regard to the fencing is concerned it falls under the private interest of the petitioner and hence no assistance or protection will be provided by the official respondents for the same. Therefore the said request of the petitioner is rejected. 7.It is made clear that this order is passed solely for the purpose of directing respondents 2 and 3 to conduct a survey and demarcate the subject property. If any dispute arises regarding the possession of the property, it must be resolved by filing a suit before a competent Civil Court. In the event of a title dispute, official respondents shall not take possession of the property and hand it over to any party. It is up to the parties concerned to seek recovery of possession through the due process of law. 8.With the above direction, this writ petition is disposed of.
