The present Writ Petition is filed seeking a Writ of Mandamus declaring the inaction of the respondents in implementing the mandatory e- NAM (National Agriculture Market) online auction and e-trading system at the Chilakaluripet Agricultural Produce Market Committee, despite the market having been integrated and notified under the e-NAM platform, as illegal, arbitrary and violative of Articles 14, 19(1)(g) and 21 of the Constitution of India. They consequently seek a direction to the respondents to ensure effective implementation of the e-NAM guidelines by introducing online bidding, transparent price discovery and a digital trading system in the said market. 2. Heard Sri Ravi Teja Gude, learned counsel for the petitioner, Sri GangisettyRajeswara Rao, learned Standing Counsel for Agriculture Marketing Committees and Ms.M.Sandhya Deepthi, learned Assistant Government Pleader for Agriculture. 3. Learned counsel for petitioner would submit that the respondents have failed to implement the e-NAM facility in the Chilakaluripet Agricultural Produce Market Committee, despite the market having been integrated with the e-NAM platform. He would contend that such inaction is intended to favour a limited group of buyers, thereby depriving the farmers of the 4 benefits of a transparent and competitive bidding process. It is submitted that the non-implementation of the e-NAM system defeats the very object of the scheme, namely, ensuring fair price discovery and providing better market access to farmers. He would further submit that the Government of India has formulated the e-NAM scheme and issued guidelines to the States and Union Territories requiring them to take all necessary legislative and executive measures to ensure effective implementation of the scheme in all notified market yards. 4. Learned Assistant Government Pleader for Agriculture would submit that an appropriate direction may be issued to respondent No.4 to consider the representation submitted by the petitioner and to take all necessary and effective steps for implementation of the e-NAM scheme by issuing appropriate directions to the concerned Agricultural Market Committee. She would further submit that the requisite infrastructure may be provided and adequate awareness programmes may be conducted among the farmers and traders to facilitate effective implementation of the e-NAM system within a reasonable time frame. 5. Learned Standing Counsel appearing for the Agricultural Market Committee would submit that it is the statutory obligation of the Market Committee to provide necessary infrastructure and facilities to farmers and traders to enable them to carry on agricultural marketing activities within the 5 notified market area. He would submit that the Market Committee is committed to discharging its statutory responsibilities in accordance with the provisions of the relevant enactment. 6. In the light of the above submissions made and since the representation of the petitioner, dated 06.02.2026 is pending for consideration before all the respondents, it is apposite to dispose of the present writ petition with a direction to Respondent No.4/Commissioner & Director of Agriculture Marketing, Andhra Pradesh at Guntur, to consider the representation of the petitioner and take all measures for effective implementation of the e-Nam facility as prayed for in the interest of Formers and Traders, as per the Rules and Law, within a period of three (3) months from the date of receipt of a copy of this order. 7. With the above direction, the Writ Petition is disposed of. Interim orders granted earlier if any, stand vacated.
