ORAL ORDER
The petitioner is before this Court calling in question proceedings in S.C.No.36/2026 registered for the offences under Sections 75(1) (i) (ii), 115(2), 324(3), 351(3) and 79 of BNS, 2023.
2. Heard Sri. Suresh N., learned counsel appearing for the petitioner, Sri. B.N. Jagadeesha, learned Addl. SPP appearing for respondent No.1, Sri. Shivanagouda M.B.,
learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a memorandum of understanding. The memorandum of understanding so filed reads as follows:
"MEMORANDUM OF UNDERSTANDING This memorandum of understanding is made and executed on this 19th day of May 2025. Between:

Aged about 39 years, R/at 923, 8th Cross, Havanuru Layout, Defence Colony, Bagalagunte, Nagasandra, Bangalore North-560073. Aadhaar No.5101 8640 5384. Mob:9513471207. Herein after called the party as (FIRST PARTY). And
Smt. BABITA.S C/o. Sham Singh H B Aged about 28 years, R/at No. 16/18, 9th Main, 15th Cross, Ray Aquatic Centre, Lakkasandra Extension, Adugodi post, Bangalore South, Bangalore 560030. Aadhaar No.7538 8786 4422. Mob:7019056327. Hereinafter called the party as (SECOND PARTY). The terms of first and second party shall whatever the context so admits and assigns etc as follows. WHEREAS, the first and second parties are residing and working in Bangalore City respectively and were office colleague. Due to misunderstanding between them, the 2nd party has lodged a complaint against the 1st party at Halasur Police Station on 31-10-2024 and the same was registered as Crime No.308/2024 for the offence punishable under Section 115(2), 324(3), 351(3), 352, 75, 76 of BNS, 2023 pending before the Hon'ble 10th ACJM, Mayo Hall, Bangalore City to file final report by the concerned police. As well as the 1st party was also lodged the complaint against 2nd party on 06.11.2024 at Bagalagunte Police Station, the same was registered as Crime No.415/2024 for the offence punishable under Section 115(2), 351(2) of BNS, 2023. The said case is pending before the Hon'ble 31st ACJM, Bangalore City for the stage of await final report by the concerned police. Whereas, the 1st and 2nd Parties have agreed that, they are withdrawing the allegations as stated in their complaints respectively and are ready to withdraw the

case between each other in respect of the above said two cases in accordance with law.
Whereas, the 1st and 2nd Parties have agreed that, if the parties failed to withdraw the case as not pressed in their cases and if anyone contested the case, then the defaulter should pay the compensation amount of Rs.1 Lakh to the opposite party/victim person. Whereas, the 1st and 2nd Parties have agreed that, they have appointed their advocate by name Suresh N to take legal assistance to compromise the above said two cases in accordance with law and both of them have agreed to pay advocate fee of Rs.30,000/- as advised by their advocate. Whereas, the 1st and 2nd parties have agreed that, both party should follow the advice of their advocate to dispose of their cases as soon as possible and they have to co- operate each other to attend the cases as fixed the date by the court and their advocate. Whereas, the 1st and 2nd Parties have agreed that, if the police/or court called the 1st and 2nd Parties for any investigation or enquiry or evidence in their cases, each party should write in the police records or court records in respect of compromise the case and not interested to contest the matter against each other and co-operate to the concerned police to file B Report in respect of their cases respectively. Whereas, the 1st and 2nd Parties have agreed that, after acquitted by their cases, they have to terminate their contacts without disturbing each other. Whereas, Both parties agreed that, if any party failed to follow the said terms and conditions, then each party will have rights to claim for compensation against defaulter as mentioned above. This Memorandum of understanding will be cancelled automatically, when the above said two cases will be closed and acquitted in their respective cases before the Hon'ble concerned Courts.

IN WITNESS WHEREOF, the parties have signed this original (the original MOU is in the custody of their advocate and two copies of the same are duly signed by both parties will be in the custody of both parties) and this MOU is executed between each other on this day, month and year first above written at Bangalore in the presence of witnesses."
4. In the light of the memorandum of understanding being filed and offences not being against the State, I deem it appropriate to accept the same and terminate the proceedings against the petitioner in the subject petition. 5. For the aforesaid reasons, the following:
ORDER i. Criminal Petition is disposed. ii. Proceedings in S.C.No.36/2026 pending before the XLV ACC & SJ, Bangalore City (CCH-46), stand quashed qua the petitioner.
