For Petitioner(s): Mr.P.Kannankumar For Respondent(s): Mr.A.Amarnath Counsel for Government of Tamil Nadu (Criminal side) COMMON ORDER These Criminal Miscellaneous Petitions have been filed to suspend the sentence imposed on the petitioner and to exempt him from surrendering pursuant to the judgment dated 07.07.2026 passed in Crl.A.No.109 of 2023 on the file of the learned Additional District and Sessions Judge, Tiruvannamalai, modifying the sentence passed in C.C.No.283 of 2019 dated 16.10.2023 passed on the file of the learned District Munsif cum Judicial Magistrate, Kalasapakkam and to enlarge the petitioner on bail pending disposal of the above criminal revision. https://www.mhc.tn.gov.in/judis CRL MP No. 15348 of 2026 __________ Page3 of 6 2. The petitioner has been convicted and sentenced by the learned Trial Judge as follows:- Conviction under Section Sentence awarded 325 of IPC To undergo one year Simple Imprisonment and further directed to pay fine of Rs.3,000/-. 3. Aggrieved by the same, the petitioner filed a Criminal Appeal in Crl.A.No.109 of 2023, and the learned Additional District and Sessions Judge, Tiruvannamalai confirmed the conviction, while modifying the sentence by reducing the period of imprisonment passed in C.C.No.283 of 2019, dated 16.10.2023 on the file of the learned District Munsif-cum-Judicial Magistrate, Kalasapakkam. Aggrieved by the same, the petitioner has filed the present Criminal Revision Case before this Court along with the instant criminal miscellaneous petitions seeking suspension of sentence and exemption from surrendering before the Trial Court. 4. The learned counsel for petitioner would submit that the petitioner has raised substantial grounds in this revision and hence, he prayed for suspension of sentence. 5. The learned counsel for Government of Tamil Nadu (Criminal Side) https://www.mhc.tn.gov.in/judis CRL MP No. 15348 of 2026 __________ Page4 of 6 did not raise any serious objection for granting suspension of sentence to the revision petitioner. 6. Considering the fact that there are substantial grounds raised in the above revision, which require consideration and since the revision is not likely to be taken up in the near future, this Court is inclined to grant suspension of sentence and exempt the petitioner from surrendering before the Trial Court. Accordingly, till the disposal of the Criminal Revision Case, the reliefs of suspension of sentence and bail are granted on the following conditions: (a) The petitioner/accused is ordered to be released on bail, on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each for a like sum to the satisfaction of the learned District Munsif cum Judicial Magistrate, Kalasapakkam. (b) The petitioner/accused and the sureties shall affix their photographs and Left Thumb Impressions in the surety bonds and the Magistrate may obtain a copy of their Aadhaar Cards or Bank Pass Books to ensure their identities. 7.
