2. Mr. Yogesh Pandey, learned Deputy Advocate General for the State/respondent nos.1 to 4.
3. Mr. Vipul Sharma, learned counsel for respondent no.5-Nagar Nigam, Rudrapur.
4. The writ petition has been filed by the trustee of an unregistered trust seeking a direction to the State Government to take the temple, which is under the management of the trust, under its control and superintendence.
5. It is contended by learned counsel for the petitioner that there are certain irregularities in the management of the trust and its finances, therefore, present writ petition has been filed.
6. Petitioner has a remedy to file a civil suit under Section 92 of CPC before the competent court having jurisdiction, wherein she can very well seek various reliefs, including a direction to the trust to frame a scheme for its administration and management.
7. In such view of the matter, this Court is not inclined to interfere in the matter.
8. At this stage, learned counsel for the petitioner seeks permission to withdraw the present writ petition, enabling the petitioner to approach the appropriate forum for redressal of her grievance.
9. Permission, so sought, is granted.
10. The writ petition is dismissed as withdrawn. Petitioner may avail the remedy available to her under law before appropriate Court.
