Order 15/04/2026
1. On the request and with the consent of the learned counsel appearing on behalf of both the parties, the present writ petition is taken up and heard for final disposal at the admission stage.
[2026:RJ-JP:15748] (2 of 3) [CW-4234/2026]
2. The present writ petition has been filed challenging the order of termination dated 05.12.2025 (Annex.7).
3.
Learned counsel appearing on behalf of the petitioner submits that the present writ petition has been filed in the background that the Tribunal constituted under the Rajasthan Non-Government Educational Institutions Act, 1989 (hereinafter referred to as ‘the Act of 1989’) was non-functional on account of the vacancy of the Presiding Officer.
4. It is stated by learned counsels appearing on behalf of both the parties that the Presiding Officer has now been posted and the petitioner has already invoked the jurisdiction of the Tribunal.
5. The limited grievance of the petitioner is that the interim protection which has been granted herein pending the proceedings shall be extended till the disposal of the interim application filed before the Tribunal in a time-bound manner.
6.
Learned counsel appearing on behalf of the respondents expresses urgency and also submits that, due to the interim orders, the respondents have been subjected to loss.
7. Balancing the interests of both the parties, this Court is inclined to dispose of the present writ petition while directing the Tribunal to decide the case within a reasonable time. However, the Tribunal is directed to dispose of the interim application within a period of one month from the date of receipt of a copy of this
order.
8. Till the disposal of the interim application pending before the Tribunal, the stay granted by this Court shall continue. If there is any delay in the disposal of the interim application on account of
[2026:RJ-JP:15748] (3 of 3) [CW-4234/2026] any adjournment sought by the petitioner, the interim order granted by this Court shall automatically stand vacated.
9. With the aforesaid directions, the present writ petition is
disposed of.
10. All pending application(s), if any, shall also stand dispose of.
