1. Heard learned counsel for the parties.
2. This appeal is directed against the order dated 23.12.2025 disposing of the respondent’s W.P.(S) No. 7559/2025.
3. Learned counsel for the appellants expresses several apprehensions, which, in our opinion, are quite misconceived. Even the stage for expressing such apprehensions has not arrived.
4. The impugned order merely notes that the respondent herein was superannuated on 31.12.2025, that some vacancies had arisen and at least one of his seniors has already been promoted. The learned Single Judge merely directed the respondents to consider the case of the petitioner and others falling within the zone of consideration for promotion. Reference to the case of Major General H. M. Singh Vs. Union of India & Anr. reported in (2014) 3 SCC 670 is only to remind the respondents that it is their duty to consider the case of their employees for promotion in accordance with law and on its own merits. This is not a case where any positive direction has been issued to promote the respondent or any other

person falling within the zone of consideration. The direction is only to consider such persons for promotion in accordance with law and on its own merits.
5. Accordingly, we see no error warranting any interference in this appeal.
6. This appeal is accordingly dismissed without any order for costs.
7. Pending interlocutory applications also stand disposed of.
