JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court seeking the following prayer: "To quash the FIR in Crime No.11/2025 of DCRE Police Station, Mysore for offences under Sections 115(2), 74, 133, 352 of BNS and under Section 3(1)(s), 3(1)(w)(i), 3(2)(va), SC and ST Act,2015, on the file of Hon'ble 6th Additional District and Sessions Judge, Mysore." 2. Heard Sri. Sanmukh Reddy, learned counsel appearing for the petitioner, Sri. K Nageshwarappa, learned HCGP appearing for respondent No.1, Sri.B S Manjunatha, learned counsel appearing for respondent No.2 and have perused the material on record. - 3 - HC-KAR NC: 2026:KHC:10958 CRL.P No. 2116 of 2026 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a compounding application under Section 359(2) read with 528 of Bharatiya Nyaya Suraksha Sanhita, 2023 (BNSS), along with affidavit. The Joint affidavit reads as follows: "JOINT AFFIDAVIT We, 1) Mr. Dinesh Kumar, S/o. Murthy N R, Aged about 37 years, R/at No.10A, 3rd Block, 3rd Stage, ESI Quarters, Gokulam, Ontikoppal, Mysore City-570002, 2) Smt. Rajeshwari N, W/o. B Srinivasa, Aged about 46 years, R/at.No.A3-1, ESI Hospital Quarters, 3rd Stage, Mysore City-570002, today visit to Bangalore, do hereby jointly & solemnly affirm and state on oath as follows: 1. We the second respondent and petitioner in the above petition. We will well conversant with the facts of this case and hence swearing to this affidavit. 2. We submit that, second respondent had lodged complaint before DCRE Police Station, Mysore alleging that the petitioner abused respondent No.2 in filthy language, pushed her with hands and thrown slipper on her, then the petitioner again abused her in filthy language by making caste remarks and also assaulted her with hands and tried to outrage her modesty. Upon which F.I.R. in Crime No.11/2025 on the file of Hon'ble 6th Additional District and Sessions Judge, at Mysore of DCRE Police Station, Mysore for offences under Sections 115(2), 74, 133, 352 of BNS and under - 4 - HC-KAR NC: 2026:KHC:10958 CRL.P No. 2116 of 2026 Section 3(1)(s), 3(1)(w)(i), 3(2)(va), SC and ST Act,2015. 3. Now on our own accord, we have decided to compound the offences alleged against this petitioner. We state that the petitioner and second respondent resolved our dispute amicably with the intervention of elders, friends and well-wishers. We state that, we had resolved our issues outside the court and we have no objection to quash FIR in Crime No.11/2025 on the file of Hon'ble 6th Additional District and Sessions Judge, at Mysore of DCRE Police Station, Mysore for offences under Sections 115(2),74,133, 352 of BNS and under Section 3(1)(s), 3(1)(w)(i), 2(2)(va), SC and ST Act,2015, against the petitioner herein. 4. We submit that, we are agreeing to compound the offences alleged against the petitioner and we are consenting for quashing of criminal case (FIR) initiated against the petitioner in Crime No.11/2025 on the file of Hon'ble 6th Additional District and Sessions Judge, at Mysore of DCRE Police Station, Mysore for offences under Section 3(1)(s), 3(1)(w)(i), 3(2)(va), SC and ST Act,2015 and second respondent have no objection to quash the FIR pending before Court below. I have not been forced or coerced by anyone for this decision. We do hereby, declare that the name and signature of me and the contents of this affidavit are true and correct to the best of my knowledge and belief." 4. In the light of application for compounding being filed along with the affidavits and offences not being against the State, I deem it appropriate to accept the compounding application and terminate the proceedings against this petitioner in the subject petition. - 5 - HC-KAR NC: 2026:KHC:10958 CRL.P No. 2116 of 2026 5. For the aforesaid reasons, the following: ORDER i. Criminal Petition is disposed. ii. Proceedings in Crime No.11/2025 on the file of Hon'ble 6th Additional District and Sessions Judge, Mysore of DCRE Police Station, Mysore, stands quashed qua the petitioner.
