This Civil Miscellaneous Petition has been filed, seeking to condone the delay of 479 days in filing the appeal. The petitioner is the defendant in the suit O.S. No. 2294 of 2023 on the file of the XVII Additional City Civil Court, Chennai. 2. Under the impugned judgment and decree, dated 20.08.2024, passed in O.S. No. 2294 of 2023 by the XVII Additional City Civil Court, Chennai, the petitioner has been directed to pay a sum of Rs.30,00,000/- to the respondents/plaintiffs together with interest and costs. The petitioner/defendant claims that he is not liable to pay the suit claim. 3. According to the petitioner/defendant, since he was suffering from ill health and he was also detained in the prison on a false complaint, given by the respondents/plaintiffs, there was a delay on his part to prefer the appeal before this Court, aggrieved by the impugned judgment and decree passed by the trial court. 4. Notice has been duly served in this Civil Miscellaneous Petition on the respondents. Their names are also printed in the cause list today. Hence, the respondents/ plaintiffs are set ex parte in this Civil Miscellaneous Petition. 5. Since sufficient cause has been shown by the petitioner/defendant for condoning the delay of 479 days in preferring the appeal, this Court is inclined to allow this Civil Miscellaneous Petition as prayed for. Accordingly, this Civil Miscellaneous Petition is allowed as prayed for and the Registry is directed to number the appeal, if it is otherwise in order.
