1. The present application is filed for condonation of delay of 72 days caused in filing the Criminal Revision Application. 2. Ms. Dalal, learned Counsel for the applicant submits that the applicant had earlier wrongly filed a Criminal Appeal. This Court, vide order dated 19/11/2025, had allowed the applicant to withdraw the appeal with permission to take appropriate steps for filing a Revision. Revision Application is filed by the applicant by engaging a Counsel from the Legal Aid Panel. Thus, there is a delay of 72 days caused in filing the Revision Application. The delay is not inordinate or deliberate and hence the same may be condoned in the interest of justice, giving an opportunity to the applicant to adjudicate his rights on merits.
Learned Counsel for the applicant, therefore, prays for condonation of delay. 2026:BHC-NAG:11676

Mr. Ghogre, learned Additional Public Prosecutor for the respondent Nos.1 and 2 though strongly opposes the said application, however, admits that earlier the applicant had filed an appeal bearing Criminal Appeal St. No.5594/2022. This Court vide order 19/11/2025 had permitted the applicant to withdraw the appeal with liberty to file Revision Application. Hence, appropriate orders may be passed. 4. Prima facie, it appears that the applicant had earlier approached this Court by filing a Criminal Appeal. This Court vide order dated 19/11/2025 had allowed the applicant to withdraw the same with liberty to file Revision Application. Thereafter, the applicant has filed the present Revision Application by engaging a Counsel from Legal Aid Panel. Hence, I am inclined to exercise discretion of this Court and pass the following order. 5. Criminal Application is allowed. Delay of 72 days caused in filing the Revision Application is hereby condoned. The Revision Application shall be registered and listed for hearing in the week commencing from 15/09/2026. (MEHROZ K.
