1. Mr. Ankur Sharma, learned counsel for the petitioners.
2. Petitioner is defendant of Civil Suit No. 155 of 2024 filed this petition for expediting the proceedings of Civil Suit No. 155 of 2024 (Baleshwar Singh Guleriay Vs. Lalitshwar Singh Guleriaya), pending in the court of Civil Judge (SD), Vikas Nagar, Dehradun.
3. It is submitted that both the parties to the suit are real brothers and suit has filed by the respondent plaintiff seeking declaration of the family settlement as null and void. He submits that in the suit, petitioner has already filed his written statement but uptil date, no issue has been framed though the suit was filed in the year 2024. Both the parties are senior citizens, therefore, suit be expedited.
4. Relief as sought by the petitioner appears to be innocuous.
5. In such view of the matter, the instant writ petition is disposed of finally with the direction to the learned Civil Judge (SD), Vikas Nagar, Dehradun to expedite the proceeding of Civil Suit No. 155 of 2024 (Baleshwar Singh Guleriay Vs. Lalitshwar Singh Guleriaya), preferably within six month from the date of presentation of the certified copy of this order.
