GP FOR HOME The Court made the following: ORDER: The Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief:- “…to issue a Writ Order or Direction more particularly one in the nature of Writ of Mandamus to declare the action of Respondents in summoning the Petitioner to the Police Station on dayday basis without issuance of any notice or assignment of valid/cogent reasons as per se illegal highhanded manifestly arbitrary and in violation to Article 14 21 and 300A of the Constitution of India and/or to pass such order(s).” 2. Heard the learned Counsel for the Petitioner and the learned Assistant Government Pleader for Home. 3. Sri Sanneboina Bhargav, learned Counsel for the Petitioner, submits that the Petitioner is being unnecessarily called to the police station at the behest of a third party and is subjected to harassment without any valid or cogent reasons. 4. Sri P. Ajay Babu, learned Assistant Government Pleader for Home, on written instructions, submits that one Thalluri Seethaiah has lodged a complaint against the Petitioner. Respondent No.4, in order to conduct a preliminary enquiry as contemplated under Section 173(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity, ‘BNSS’), had called the Petitioner to the police station, but the Petitioner did not turn up. After conducting the preliminary enquiry, it came to light that there are certain monetary transactions of a civil nature pending between the Petitioner and the 3 Dr.YLR, J W.P.No.8974 of 2026 Dated 15.04.2026 said third party. Therefore, Respondent No.4 has not interfered further in the civil dispute between the Petitioner and the said third party. 5. Considering the facts and circumstances of the case and recording the submissions of the learned Assistant Government Pleader, the Writ Petition is disposed of, directing Respondent No.4 not to summon the Petitioner to the police station hereafter without any basis and not to interfere in the monetary transactions of a civil nature pending between the Petitioner and Thalluri Seethaiah. There shall be no order as to costs. As a sequel, miscellaneous petitions, if any pending shall stand closed. _________________________ DR. Y.
