CRL OP No. 22470 of 2026 __________ Page2 of 5 ORDER The petitioners, who were arrested and remanded to judicial custody on 26.06.2026 for the alleged offence under Sections 303(2) of BNS Act, 2023 (under Section 379 of IPC) in Crime No.65 of 2026 on the file of the respondent police, seeks bail. 2. The case of the prosecution is that the petitioners have committed the theft of copper coil (HT-coil, LT-coil) and insulation oil(440 liters) belonging to Tamil Nadu Electricity Board at Eeyyanur and the same is worth about Rs.2,50,000/-. The contraband also not recovered from these petitioners. Hence, the case. 3. The learned counsel appearing for the petitioners submitted that the petitioners have been falsely implicated in this case and that they have not committed any offence as alleged by the prosecution. He further submitted that these petitioners are in custody since 26.06.2026 and they are ready to abide by any stringent conditions that may be imposed by this Court. Per contra, the learned Government Advocate (Criminal Side) appearing for the Respondent Police reiterated the prosecution case and submitted that these petitioners indulged in the theft of copper coil (HT-coil, LT-coil) and insulation oil(440 liters) worth about totally Rs.4,78,000/- and A1 is having eight previous cases out of which seven are similar in nature and A2 is having seven previous cases pending against him and the contraband were not recovered from them and this case is still under investigation. Hence, he opposed the grant of bail to the Petitioners. 5.
Heard the learned counsel appearing for the petitioners, the learned Government Advocate (Crl.Side) for the respondent Police and perused the materials available on record. 6. Considering the facts and circumstances of the case and submission of the learned Government Advocate (Crl.Side) that A1 is having 8 previous cases and A2 is having 7 previous cases pending against him and contraband is also not recovered from these petitioners, and that the investigation has not yet been completed and in such view of the serious nature of the allegations, the alleged role attributed on these petitioners, if they are enlarged on bail, there is every possibility of them tampering with witnesses and hence, this court is not inclined to grant bail to these petitioners. https://www.mhc.tn.gov.in/judis
