CMP(M) No.470 of 2026 Delay of 166 days in filing the present appeal is condoned in view of the averments made in the application duly supported by an affidavit. The application stands disposed of. Learned Additional Advocate General submits that though the benefit of work-charge status has been granted to the petitioner in view of the settled principle, but that there was a break in service w.e.f. 13.03.1992 (Annexure R-III, Pages-144/145) till his re-joining on 25.08.1998, which would be clear from the order of regularization dated 02.12.2003 (Page-76), which has also been mentioned in the written statement but not in a concise manner, while referring to Paragraphs-6 & 7 of the written statement. Therefore, it could not be brought to the notice of the learned Single Judge in the manner, in which it ought to have been. It is thus submitted that as per the Policy also, 160 days of service in each year would have to be adhered to.
