1. Heard.
2. In response to order dated 06.08.2026, learned AGP has tendered across the Bar the communication dated 02.09.2026 issued by the Deputy Secretary, Maharashtra State, addressed to the learned AGP, saying that the officials were found guilty of not discharging duties in terms of Section 10 of the Maharashtra Government Servants Regulation of Transfers and Prevention of Delay in Discharge of Official Duties Act, 2005 (for short, “the Act of 2005”). They have been issued warning not to repeat such mistake by the Director of Education (Primary), Pune.
3. The communication dated 02.09.2026 is taken on record and marked as Article ‘X’ for identification.
4. Learned AGP shall take instructions from the Director of Education (Primary), Pune, as also the Deputy Secretary, State of Maharashtra, as to how this mode of issuing warning is permissible in terms of Section 10 of the Act of 2005.

6. Learned AGP has tendered across the Bar order dated 03.09.2026 passed by the Principal Secretary, State of Maharashtra.
7. It appears that action in terms of Sub-Section (3) of Section 10 of the Act of 2005 has been taken against the erring officials, including the Director of Education (Primary), Pune.
8. The order dated 03.09.2026 is taken on record and marked as Article ‘Y’ for identification.
9. As regards the relief in the petition is concerned, we are informed that the Principal Secretary has passed order dated 31.07.2026 denying the benefit to the petitioners.
10. In view of the above, the counsel for the petitioners, on instructions, seeks permission to withdraw the petition with liberty to challenge the order dated 31.07.2026.
11. Permission is granted.
