GP FOR FINANCE PLANNING SRK,J W.P No.9547 of 2026 3 THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY Writ Petition No:9547 of 2026 The Court made the following Order: This Writ Petition is filed seeking the following relief: “...to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of respondents in not releasing the admitted bills amount of Rs.10,00,000/- (Rupees Ten Lakhs only) for construction of CC Roads in Sainagar area, Byrapuram Gram Panchayat of Kotha Cheruvu Mandal, Satya Sai District 14/15th Finance Commission funds is illegal, arbitrary and unreasonable and violation of article 14,19 and 21 of Constitution of India, consequently direct the respondents to pay the net Amount of Rs.10,00,000/- (Rupees Ten Lakhs only) with interest and consequential reliefs and to pass such other order…” 2. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Panchayat Raj and Rural Development. 3. The petitioner is a registered contractor who was entrusted with laying of five (05) CC Road works by the Gram Panchayat, through Resolution Nos.107 to 111 dated 24.12.2020 under the 14th/15th Finance Commission Grants, for a total value of Rs.10,00,000/-. The petitioner completed all the works to the satisfaction of the concerned authorities under the supervision of the Engineering Department. The measurements were duly recorded in the Measurement Books and the works were recommended for payment. However, despite completion of the works and admission of the bills, the respondents have failed to release the amount of Rs.10,00,000/- and allegedly diverted the funds for other purposes. It is the case of the petitioner SRK,J W.P No.9547 of 2026 4 that he borrowed money on interest to execute the work and is suffering serious financial hardship due to non-payment of admitted bill amount. 4. It is the grievance of the petitioner that notwithstanding the completion of the work and its measurement by the competent authorities, the amount due towards the executed work has not been paid till date and the funds are diverted for some other purposes. According to the petitioner, although the work was completed more than few years ago, the respondent authorities have not released the admitted amount payable to him. Aggrieved by the non- payment of the said amount, the petitioner filed the present Writ Petition. 5. Learned Assistant Government Pleader, on written instructions, from the Panchayat Secretary, Byrapuram (G.P), Kothacheruvu Mandal, Sri Sathya Sai District, submits that there is no dispute with regard to the execution of the work. According to him, the petitioner is entitled to an amount of Rs.10,00,000/- and that amount could not be released due to the non- availability of sufficient funds with the Gram Panchayat and six months’ time is sought for payment of the said amount. The written instructions are placed on record. 6. Having regard to the fact that there is no dispute with regard to the work executed by the petitioner and the amount payable to him, and in view of the submissions of the learned Assistant Government Pleader, the respondent authorities are directed to pay a sum of Rs.10,00,000/- (Rupees Ten Lakhs SRK,J W.P No.9547 of 2026 5 Only) to the petitioner within a period of six (06) weeks from the date of receipt of a copy of this order. 7. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
