Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner is apprehending his arrest in connection with Khunti P.S. Case No. 170 of 2024, registered for the offence under Sections 111, 317(4), 317(5) of Bhartiya Nyaya Sanhita, 2023, Section 12 of Jharkhand Bovine Animal (Prevention of Slaughter) Act and Section 11 of Prevention of Cruelty to Animal Act pending in the court of learned Chief Judicial Magistrate, Khunti.

Learned counsel appearing for the petitioner submits that the petitioner has earlier moved before this Court in A.B.A. No.1768 of 2025 which was dismissed as withdrawn.

Learned counsel appearing for the State has opposed the prayer and submits that there is no fresh ground and earlier anticipatory bail application was withdrawn. He submits that in identical situation arising out of the same FIR, second anticipatory bail application filed by the co-accused has been rejected by this Court in A.B.A. No.1563 of 2026.

Considering that the anticipatory bail application of the petitioner was dismissed as withdrawn in A.B.A. No.1768 of 2025 and in course of argument, no fresh ground has been argued to maintain the second anticipatory bail application and in identical situation, second anticipatory bail application of the co-accused has already been rejected as argued by the learned counsel for the State, I am not inclined to grant anticipatory bail to the petitioner.
Accordingly, this anticipatory bail is hereby rejected.
