BEFORE HONOURABLE MR. JUSTICE RAJESH MAZUMDAR ORDER 21.05.2026 Heard Mr. Beria, learned counsel appearing for the petitioner. Also heard Ms. NN. Sarma, appearing on behalf of Mr. K. Gogoi, learned counsel CGC, who prays for an accommodation to file their affidavit-in-opposition, since the instructions have been received. Affording such an opportunity, list this matter on 18.06.2026 . The petitioner has renewed his prayer for suspension of the order dated 16.12.2026. The learned counsel has submitted that since the order of conviction has been stayed by the Appellate Court, the interim prayer of the petitioner may be considered at this stage. The matter is one of dismissal from service vide Order dated 16.12.2025, on the basis of the conviction of the petitioner. Since the respondents have been served with the copy of the order by which the conviction has been kept in abeyance, it would be open for the respondents to reconsider the dismissal of the petitioner, since on the Page No.# 3/3 basis of merits of the appeal, the conviction has been kept in abeyance by the Appellate Court. The decision of the respondent authorities with regard to the reconsideration of the dismissal order, if any, shall be placed before this Court on the next date of hearing. The petitioner is allowed to renew his prayer on the next date of listing. The respondent shall ensure filing the affidavit-in-opposition before the next date of listing. JUDGE Comparing Assistant
