Kausik (Allowed) CRM (M) 2694 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kolaghat Police Station Case No. 123 of 2025 dated 24.03.2025 under Section 64(2) of BNS, 2023 and Section 6(1) of POCSO Act, 2012. And In the matter of : Sk. Mohammad Hujaifa @ Sk. Jobet ……Petitioner. Mr. Debabrata Roy Mr. Bibekananda Tripathy Ms. Sarbani Mukherjee ……for the Petitioner. Mr. Z.N. Khan Ms. Debjani Sahu ……for the State. Learned advocate for the petitioner submits that the petitioner is in custody for 11 months and he has been implicated on the basis of statement of the victim. Learned advocate further submits that the evidence of the victim is in progress. A document has been handed over which shows that the examination-in-chief proceeded but the same has been deferred on the ground of non-production of Alamat. Learned advocate for the State opposes the prayer for bail and draws the attention of the Court to the statement of the victim under Section 183 of BNSS. 2 I have taken into account the statement of the victim as well as the deposition before the Court. Having considered the same, I am of the view further detention of the petitioner is unwarranted. Accordingly, the prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Sk. Mohammad Hujaifa @ Sk. Jobet shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Judge, POCSO Court, Tamluk, Purba Medinipur. If on bail, the petitioner shall not enter the jurisdiction of Kolaghat Police Station except for the purposes of attending the Court. The petitioner shall once in a month meet with the Officer-in-Charge of Nandigram Police Station or any Officer deputed by him. Petitioner shall be physically present on each and every date fixed by the learned Trial Court. Thus, CRM (M) 2694 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
