Mr. Gaurav Pawar, Advocate for the petitioner. 2. Mr. G.S. Negi, Additional Chief Standing Counsel for the State of Uttarakhand. 3. Petitioner volunteered himself for serving as Sports Trainer in Block Narsan during financial year 2024-25, and he was engaged for the said financial year, vide order dated 23.07.2024. Petitioner has challenged advertisement dated 25.04.2026, issued by District Youth Welfare and Prantiya Rakshak Dal Adhikari, Haridwar, whereby applications are invited from eligible persons for appointment as Sports Trainer. The said appointment is to be made till March, 2027. 4. Petitioner contends that since his name is recommended by Block Development Officer, Narsan for engagement as Trainer during financial year 2026-27, therefore, it was not proper for respondent no. 3 to invite applications instead of appointing the petitioner. 5. Learned State Counsel was asked to get instructions. On instructions, learned State Counsel submits that the recommendation made by Block Development Officer was withdrawn on 30.04.2026 by the concerned Block Development Officer. He further submits 2026:UHC:4099 that since the selection is to be made at the district level, therefore, Block Development Officer has no authority to make recommendation for appointment of the petitioner. 6. This Court finds substance in the submission made by learned State Counsel. Merely because petitioner discharged duties as Sports Trainer during financial year 2024-25 on voluntary basis will not entitle him to claim appointment as Sports Trainer, as a matter of right. Even otherwise also, appointment to any position under the State has to be made after due selection, therefore, there was nothing wrong, if respondent no. 3 invited application from eligible persons for appointment as Sports Trainer. 7. Thus, there is no scope for interference with the advertisement dated 25.04.2026. The writ petition fails and is dismissed. However, petitioner shall be at liberty to submit application, pursuant to the said advertisement within 24 hours; and application, if made, shall be considered along with other candidates, as per law.
