Heard learned counsel Shri N.D.Jambhule for the petitioner and learned Assistant Government Pleader Mrs.Shamsi Haider for respondent No.2. 2. The petitioner – student has approached this court seeking a direction to respondent No.2 – The Joint Commissioner cum Vice Chairman, The Scheduled Tribe Certificate Scrutiny Committee, Nagpur to decide caste claim of the petitioner expeditiously. 3. Learned counsel for the petitioner invites our attention to acknowledgment dated 10.1.2025 whereby caste claim of the petitioner was submitted to the said Committee for verification. The aforesaid acknowledgment is on record at page No.22 (Annexure-3). 2026:BHC-NAG:11673-DB 2 9 wp6585.26.odt He further submits that it is more than one and half year now that the aforesaid caste claim of the petitioner is not yet decided by the said Committee. The petitioner was admitted provisionally to respondent No.1 – Institute for “Bachelor of Science in Nursing Course” under the “Scheduled Tribe Category.” The Provisional Admission Letter dated 8.8.2026 (Annexure-1) substantiates the aforesaid fact. He further submits that since the admission of the petitioner is under “Reserved Category” and the same is provisional, respondent No.1 – Institute is insisting the petitioner for submission of Caste Validity Certificate and, therefore, the petitioner has approached this court. 4. Learned Assistant Government Pleader for respondent No.2, upon instructions, submits that the caste claim of the petitioner shall be decided within a period of three months from today. 5. In view of the aforesaid, we dispose of the present writ petition as per following directions: ORDER (1) The Writ Petition is disposed of. (2) The respondent No.2 – The Joint Commissioner cum Vice Chairman, The Scheduled Tribe Certificate Scrutiny Committee, Nagpur is directed to decide the caste claim of the petitioner towards “Mana Scheduled Tribe” within a period of three months from today. 3 9 wp6585.26.odt (3) In the meantime, respondent No.1 - Smt.Radhikabai Meghe Memorial College of Nursing, Dutta Meghe Institute of Higher Education & Research, Sawangi (Meghe), Wardha is directed not to cancel the admission of the petitioner for want of Caste Validity Certificate, till the decision of respondent No.2 – Committee. (4) The petitioner is directed to co-operate respondent No.2 – Committee for expeditious decision of her caste claim. (5) The aforesaid admission of the petitioner would be subject to final outcome of the caste claim decided by respondent No.2 – Committee.
