National Insurance Co. Ltd. Vs Alka Devi & Ors. CMP No. 2726 of 2026 in FAO No. 457 of 2019 26.02.2026 Present: Mr. Sambhav Bhasin, Advocate, for the appellant/non-applicant. Mr. Nitin Thakur, Advocate, for respondents No. 1 to 4/applicants. Mr. Shivalik Bhaik, Advocate, vice Ms. Shalini Thakur, Advocate, for respondent No. 5. The present application has been filed in the decided matter. As per the record, an application bearing CMP No. 32056 of 2025, moved by the applicants No. 1 to 4, was allowed and the amount was ordered to be released. However, the said amount could not be released, as the order with regard to the apportionment of the compensation has not been passed by this Court or by the Commissioner under Employee’s Compensation Act. Hence, the present application has been moved.
2. Applicant No. 1 is widow of Ajay Kumar, applicants No. 2 & 3 are his children, whereas applicant No. 4 Vidya Devi is his mother. Admittedly, applicants No. 2 and 3 i.e. Kumari Anchal Bhatia and Master Prateek Bhatia are minors.
3. Considering the number of applicants, it would be just and appropriate to apportion the amount between the applicants as under:- Applicant No. 1 = 30%; Applicants No. 2 & 3 = 25% each; and Applicant No. 4 = 20%.
4. Consequently, the amount falling in the share of applicant No. 1 Alka Devi, be released as per the order dated 05.01.2026, along with proportionate interest. Application is accordingly disposed of. ( Virender Singh )
