Apprehending his arrest in connection with Crime No.485/2025 registered with Ner Parsopant Police Station, District Yavatmal, for the offences punishable under Sections 420, 417, 406, 477-A read with Section 34 of the Indian Penal Code and Section 3 of the Maharashtra Protection of Interest of Depositors Act, 1999 (MPID), present application has been filed by the applicant. This Court vide order dated 13.08.2026, has protected the applicant by granting ad-interim anticipatory bail. 3. The learned Counsel for the applicant submits that the Rgd. 2026:BHC-NAG:11661 Order 030926aba731.26 2 applicant is an Expert Director and is not involved in misappropriation of the amount of the Society. He submits that considering the allegations, this Court has protected the applicant by order dated 13.08.2026. He further submits that other Directors of the said Society have been granted bail in bunch of applications i.e. Criminal Application No.987/2025 and others vide order date 28.04.2026, hence, even considering the observations recorded therein, the applicant is entitled for grant of anticipatory bail. 4. The learned A.P.P. concedes the fact that other Directors of the Society have already been granted bail by this Court. He however, submits that the applicant is an Expert Director, and it is his duty to give expert opinion to run the society, however, he has also participated in the act of misappropriation, therefore, he along with other Directors is also responsible for the day to day affairs of the Society, and it cannot be said that he is not responsible. Prayer is made to reject the application. 5. I have considered the rival contentions of the parties and gone through the record. I have also perused the order dated 28.04.2026 passed by this Court passed in bunch of applications, the applicants therein are Directors, Managers and Incharge Managers for the period from 1991-92 and thereafter till 2023-24. Considering the nature of allegations and the observations recorded therein, coupled with the fact that the applicant is already protected by order of this Rgd. Order 030926aba731.26 3 Court dated 13.08.2026, I am inclined to confirm the bail granted to the applicant on the same terms and conditions as are incorporated in the order dated 13.08.2026. 6.
