Heard learned counsel for the petitioner, Mr. Sanjay Kumar Singh, learned counsel for respondent-BSA and learned Standing Counsel for the State. The writ petition has been filed with the prayer to direct the respondents to grant the pension as well as all consequential benefits/dues to the petitioner within stipulated period. Learned counsel for the petitioner submits that the petitioner, who retired as Assistant Teacher on 31.03.2025, has not been paid pension and consequential retiral benefits till date. A representation in this regard has also been moved before the authorities concerned, but nothing has been done till date. Therefore, a direction may be issued to the respondent-authorities to look into the grievance of the petitioner and pay the retiral dues at the earliest. Learned counsel for respondent-BSA submits that if the petitioner submits a fresh, detailed representation before respondent no.3, the same shall be considered and decided, strictly in accordance with law. Considering the facts and circumstance of the case but without expressing any opinion on the merits of the case set up on behalf of the petitioner, the present writ petition is disposed of by providing that petitioner may make fresh detailed application/representation, ventilating all his grievances, supported by such documents, as may Versus Counsel for Petitioner(s) : Mani Shankar Counsel for Respondent(s) : C.S.C., Sanjay Kumar Singh Panchdev Ram .....Petitioner(s) State Of U.P. And 2 Others .....Respondent(s) be advised, before the respondent no.3 District Basic Education Officer, Ballia, within three weeks from today along with a certified copy of this order. On such representation being made, respondent no.3 shall make all endeavours to consider and decide the same, strictly in accordance with law, by means of a reasoned and speaking order, after giving proper opportunity of hearing to the petitioner, as expeditiously as possible, preferably within a period of six weeks from the date of production of certified copy of this order, if there is no legal impediment.
