JUSTICE SAMEER JAIN Order 06/03/2026 1. The instant bail applications have been filed under Section 483 of BNSS on behalf of accused-applicants. The accused- applicants were arrested in connection with FIR No.811/2025 registered at Police Station Kotwali, Alwar District Alwar for the offence(s) under Sections 316(4) of BNS. 2. Learned counsel for the accused-applicants submitted that offence is triable by First Class Magistrate. It is submitted that the charge-sheet has been filed and trial will take time. It is also [2026:RJ-JP:9656] (2 of 2) [CRLMB-875/2026] submitted that the applicants are not having any criminal antecedents. 3. Per contra, learned Public Prosecutor and learned counsel for the complainant have vehemently opposed the bail applications. It is submitted that recovery of Rs.38 lacs is till pending towards the applicants. 4. Considering the arguments advanced by the counsel for the parties, that the matter is triable by Magistrate-Class First; that the charge-sheet has been filed; trial will take a long time; and looking to the overall facts and circumstances of the case and material on record but without commenting on merits/demerits of the case, this court is inclined to allow the bail applications of the accused-applicants and enlarge them on bail, as it is also opined that being in custody and denial of bail cannot be considered to be a way of initiating recovery. 5. Accordingly, the bail applications under Section 483 of BNSS are allowed and it is ordered that accused-applicants Abhishek Gupta S/o Suresh Chand Gupta and Surendra Kumar Goyal S/o Shri Phoolchand Goyal shall be enlarged on bail provided they furnish a personal bond of Rs.50,000/- each, with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for their appearance before the court concerned on all the dates of hearing as and when called upon to do so. 6.
