1. Mr. Anshu Kumar, learned counsel for the petitioner.
2. Mr. Pradeep Hairiya, learned Standing Counsel for the State of Uttarakhand.
3. Petitioner was appointed as Junior Clerk in Irrigation Department in the year 1981 and he retired from service on
31.08.2018.
4. By means of this writ petition, petitioner has sought the following relief:-
(i) Issue writ, order or direction in the nature of Mandamus to respondents no. 2 & 3 to provide the notional promotion & pensionary benefits for the post of Chief Administrative office, As per notification no. 737/2003 dated 11 June
2003.

Learned counsel for the petitioner submits that petitioner was promoted as Senior Administrative Officer on 15.09.2016 and he retired on 31.08.2018, therefore, he rendered nearly two years of service on the post of Senior Administrative Officer. Thus, he submits that the stand taken in para 17 of the counter affidavit that petitioner did not complete one year service as Senior Administrative Officer is not correct.
6. Learned State Counsel, however, reiterates what has been stated in para 17 of the counter affidavit and submits
2026:UHC:1794 that since petitioner did not complete required one year qualifying service as Senior Administrative Officer, therefore, he was not considered for promotion to the post of Chief Administrative Officer. Learned State Counsel, however, submits that petitioner was given benefit of three ACPs from due dates.
7. This Court finds some substance in the submission made by learned counsel for the petitioner that after serving for nearly two years as Senior Administrative Officer, petitioner became eligible for promotion to the next higher post of Chief Administrative Officer.
8. The writ petition is, accordingly,
disposed of with a direction to the Competent Authority to reconsider petitioner’s claim for promotion as Chief Administrative Officer from due date, with all consequential benefits and pass necessary order within eight weeks from the date of presentation of certified copy of this order.
