JUSTICE G BASAVARAJA ORAL JUDGMENT The appellants have preferred this appeal against the impugned order passed by the Prl. District & Sessions Judge, Chamarajanagara in Crl. Misc. No.536/2025 dated 29.12.2025. 2. The brief facts leading to this appeal are that on the basis of the complaint filed by Deshaiah, Gundupetta Police have registered the case in Crime No. 331/2025 against the appellants/accused no. 1 to 12 for commission of offences punishable under Section 3(1)(r)(s) of SC and ST (Prevention of Atrocities) Act, 1989 and Section 351(2) and 351(3) of the Bharatiya Nyaya Sanhita (BNS), 2023. The appellants have filed application under Section 482 of BNS for grant of anticipatory bail and the same came to be rejected. Being - 4 - HC-KAR NC: 2026:KHC:7524 CRL.A No. 153 of 2026 aggrieved by the said order, the appellants have preferred this appeal. 3. The alleged incident took place on 04.12.2025. The complaint came to be filed on 05.12.2025. On careful examination of the FIR, it is clear that the names of the public who were present at the time of incident not disclosed by the prosecution. It is submitted by the learned HCGP that charge sheet is already filed against the accused. Hence these accused are not required for further investigation. Hence, I proceed to pass the following: O R D E R i) Appeal is allowed. ii) The impugned order passed by the Prl. District & Sessions Judge, Chamarajanagar dated 29.12.2025 in Crl. Misc. No.536/2025 is set aside. Consequently, application filed under Section 482 of BNS is allowed. iii) The appellants shall be released on bail in the event of their arrest in Crime No.331/2025 of Gundlupete Police Station, on they executing self bond of - 5 - HC-KAR NC: 2026:KHC:7524 CRL.A No. 153 of 2026 Rs.1,00,000/- each with one surety each for the likesum to the satisfaction of the trial Court. iv) The appellants shall appear before the trial Court on all the dates of hearing and shall co-operate for trial. v) The appellants shall not tamper or threaten the prosecution witnesses in any manner. vi) The appellants shall not indulge in similar offence.
