Heard the learned counsel for the petitioner in respect of the matter. 2. The case of the petitioner, in nutshell, is that he is in the peaceful possession of land measuring 08 Kanals 18 Marlas situated at Muqdamyari, Hajin, District Bandipora, which he claims to have purchased through a bona fide agreement more than 20 years ago, and upon which he has already raised a residential house. That he has been residing in the house and cultivating the land openly, and uninterruptedly, with his possession duly reflected in the revenue records. That the private respondent No. 8, having no right, title, or interest in the subject land, has started illegally interfering with his possession on the basis of false and frivolous claims. 3. Perused the record of the file including Annexure I, purported to be an affidavit sworn by respondent No. 7, namely Gh. Mohd. Khanday, in favour of the petitioner, wherein it is stated that the petitioner has been in possession of land measuring 02 Kanals 05 Marlas under Survey No. 342 min, situated at Srihadi Gund, and that the revenue entry in his favour to the said extent does not reflect the factual position. 4. It appears that the petitioner has not availed the alternate efficacious remedy available to him under law for establishing his legal rights and for seeking protection thereof. 5. Accordingly, the instant petition is disposed of with liberty to the petitioner to avail and seek appropriate remedy under law for the establishment of his legal rights and protection in respect thereof. 6.
