…...... 02 /23.03.2026: This bail application has been filed by the petitioner under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Sections 323/376/420/494/498/34 of the Indian Penal Code. Now, cognizance has been taken under Section 494/498A of the Indian penal Code and Section 4 of the Dowry Prohibition Act. 2. Heard, learned counsel for the petitioner, learned counsel for the State and have also gone through the impugned order. 3. Learned APP opposes the prayer for bail. 4. After hearing the learned counsel for the parties and after going through the record, I find that both the parties are major. After the death of the husband of the informant it is alleged that on the assurance of marriage this petitioner established physical relation with the informant. The relationship continued but thereafter it is alleged that this petitioner got married with someone else. Petitioner is the brother-in-law of the victim. 5. 6. Considering the nature of allegation and the fact that the parties are major, I am inclined to grant bail to the petitioner.
Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned JM 1st Class, Bermo at Tenughat in connection with Kasmar PS Case No. 113 of 2022 corresponding to GR No. 1231 of 2022 subject to the condition that one of the bailors should be a close relative of the petitioner, having sufficient landed property in his/her own name within the State of Jharkhand with a further condition that the petitioner shall appear and mark his attendance before the concerned Registrar, Civil Court once in a month till disposal of the trial. 7.
