The petitioner is apprehending his arrest in connection with Sahibganj (T) P.S. Case No. 125 of 2024, registered for the offence under Sections 191(2), 190, 126(2), 115(2), 132 and 121(1) of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Chief Judicial Magistrate, Sahibganj.

Learned counsel appearing for the petitioner submits that the petitioner is one of the villagers and false allegations are made of altercation with the police. He next submits that this petitioner was also assaulted by the police and that has been supported by the entire villagers. He further submits that the petitioner is having no criminal antecedent and disclosure to that effect has been made in para-9 of the petition. He also submits that in the similar circumstance, the other co- accused has already been provided the privilege of anticipatory bail in A.B.A. No. 7287 of 2025 by this court.

Learned A.P.P. appearing for the State has opposed the

prayer and submits that the allegation of altercation with the police is there.

Considering that the altercation took place while cleaning of the river bank during the ‘Chhath’ festival, the petitioner has also received injury and villagers have supported the case of the petitioner and further the similarly situated other co-accused person has already been provided the privilege of anticipatory bail in the aforementioned A.B.A. and further he is having no criminal antecedent and disclosure to that effect has been made in para-9 of the petition, in that view of the matter, the petitioner, named above, is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
