Petitioners PRAYER: Original Petition has been filed under Section 372 of the Indian Succession Act 39 of 1925 read with Order XXV Rule 6 of O.S.Rules praying that a Succession Certificate may be granted to the Petitioner, i.e. Mr. Purshottam Das Mundhra, with power to collect the debts and to receive the interests and dividends on and to negotiate and transfer the securities specified in the Schedule hereto. For Petitioners: M/s.Ronak Jain https://www.mhc.tn.gov.in/judis __________ Page2 of 6 ORDER This Original Petition has been filed by the petitioners seeking grant of a Succession Certificate in respect of the debts and securities forming part of the estate of late Mr. Keshava Das Mundhra, who died intestate on 19.04.2025 at Chennai, while ordinarily residing at No.3A, 3rd Floor, K.R. Castle, New No.14, Chittaranjan Road, Alwarpet, Teynampet, Chennai – 600 018, within the jurisdiction of this Court. The petitioners have stated that a diligent search was made for a Will, but no Will was found and, to their knowledge, the deceased died intestate. 2. The first petitioner, Mr. Purshottam Das Mundhra, is the son of the deceased. The second petitioner, Mrs. Uma Mundhra, is the wife of the deceased, and the third petitioner, Mrs. Preeti Daga, is the daughter of the deceased. The father and mother of the deceased, namely, Mr. Shree Das Mundhra and Mrs. Laxmi Devi Mundhra, had predeceased him. Thus, the petitioners are stated to be the surviving Class-I legal heirs of the deceased. 3. It is the case of the petitioners that the deceased left behind the debts and securities more fully described in the Schedule to the petition and that the Succession Certificate is required for collecting the amounts due and for receiving the interest and dividends and for dealing with the securities standing in the name of the deceased. https://www.mhc.tn.gov.in/judis __________ Page3 of 6 4. In support of the petition, the first petitioner, Mr. Purshottam Das Mundhra, examined himself as P.W.1 before the learned Master. 5. On behalf of the petitioners, Exs.P1 to P9 have been marked. Ex.P1 is the computer-generated Death Certificate of the deceased; Ex.P2 is the Legal Heirship Certificate issued in respect of the deceased; Exs.P3 to P6 are the statements of shareholdings standing in the name of the deceased with the respective financial institutions/brokers; Ex.P7 is the Aadhaar Card of the first petitioner; Ex.P8 is the copy of the paper publication effected in the Tamil daily Makkal Kural dated 29.04.2026; and Ex.P9 is the certificate filed under Section 63(4)(c) of the Bharatiya Sakshya Adhiniyam. 6. The evidence of P.W.1, coupled with Exs.P1 to P9, establishes the death of late Mr. Keshava Das Mundhra, the identity of his surviving legal heirs and the debts and securities standing in his name. The Legal Heirship Certificate and the statements of shareholdings support the case of the petitioners with regard to the estate in respect of which the Succession Certificate is sought. 7. The paper publication effected in Makkal Kural dated 29.04.2026 has been marked as Ex.P8 and no objection has been brought to the notice of this Court pursuant to the said publication. Further, the second and third petitioners, who are the other surviving legal heirs, have expressly consented to the issuance of the Succession Certificate in favour of the first petitioner. https://www.mhc.tn.gov.in/judis __________ Page4 of 6 8. On consideration of the pleadings, oral evidence and documentary evidence placed on record, this Court is satisfied that the first petitioner, Mr. Purshottam Das Mundhra, is entitled to the grant of a Succession Certificate in respect of the debts and securities specified in the Schedule to the petition. 9. In the result, this Original Petition is allowed.
