A.No.3562 of 2026 is filed to condone the delay of 1638 days in representing the suit. A.No.3563 of 2026 is filed to withdraw the suit and for refund of court fee. A.No.3564 of 2026 is filed to condone the defective representation. The applicant has filed affidavit stating that he has filed summary suit based on promissory note on 05.08.2021 and one of the defects raised by the Registry is the original promissory note to be filed, whether as the applicant could not trace out the original promissory note till date and so he had decided to withdraw the suit. Hence, he has filed these aplications. 2. The reason stated in the accompanying affidavit filed in support of the applications are satisfatdory and so this court is inclined to allow these applications. 3. Accordingly, these applications are allowed. The applicant is entitled to refund of court fee as contemplated under the provisions of Tamil Nadu Court Fees and Suit Valuations Act.
