02/15.04.2026 Heard Mr. Vishwajeet Kumar Tiwari, learned counsel for the appellant and learned A.P.P. for the State. This interlocutory application has been preferred by the appellant for condoning a delay of 01 day in filing the appeal. Having been satisfied with the reasons assigned in the instant application, the same is allowed and the delay of 01 day in filing the appeal is, hereby, condoned. I.A. This appeal is directed against the order dated 07.01.2026 passed in MCA No. 3087 of 2025, in S.T. No. 353 of 2024, arising out of Chhattarpur P.S. Case No. 166 of 2023, by the learned Additional Sessions Judge-VIII, Palamau at Daltonganj, whereby and whereunder, the prayer for bail of the appellant has been rejected. It has been alleged that on a raid conducted by the police that miscreants were involved in collection of levy two persons were apprehended and from the dickey of the Motorcycle Rs.5,00,000/- (Rupees Five Lakh) was recovered. It has been submitted by the learned counsel for the appellant that the appellant has not been named by the apprehended accused persons and he has been implicated

only on account of suspicion. Learned counsel submits that the apprehended accused persons have been granted bail by a Co-ordinate Bench of this Court in Criminal Appeal (DB) No. 2184 of 2023 and Cr. Appeal (DB) No. 229 of 2024. It has been submitted that the appellant is in custody since
22.08.2024. Learned A.P.P. has opposed the prayer for bail of the appellant and has submitted that the appellant has got several criminal antecedents.
Regard being had to the fact that the apprehended accused persons have been granted bail and save and except suspicion there is no other material against the present appellant, we while setting aside the order dated 07.01.2026 passed in MCA No. 3087 of 2025 in S.T. No. 353 of 2024 arising out of Chhattarpur P.S. Case No. 166 of 2023 by learned Additional Sessions Judge-VIII, Palamau at Daltonganj, direct that the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-VIII, Palamau at Daltonganj in S.T. No. 353 of 2024, arising out of Chhattarpur P.S. Case No. 166 of 2023. This appeal stands allowed. (Rongon Mukhopadhyay, J.)
