Also heard Mr. K. K. Das, learned Additional Public Prosecutor for the State of Assam. 2. This is an application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, whereby the petitioner Nichel Tayung @ Nikhil Tayung has prayed for pre-arrest bail in respect of Dergaon P.S. Case No.61/2026, under Section 69 of the BNS, 2023. 3. The petitioner was maintaining a relationship with a girl and both of them were also engaged in a physical relationship. On 02.04.2026, they travelled together on a motorcycle. After some time, an argument arose between them over an undisclosed issue, and out of anger, the petitioner abandoned the girl along with the motorcycle on the road. 4. Mr. Das, learned Additional Public Prosecutor has objected to this bail application. 5. I have considered the submissions made by the learned counsel for both sides. 6. This Court is of the opinion that for the allegation brought against the petitioner, he does not deserve to be detained in custody. Therefore, his pre-arrest bail application is allowed. Page No.# 3/3 7. It is hereby directed that in the event of arrest in connection with Dergaon P.S. Case No.61/2026, the petitioner Nichel Tayung @ Nikhil Tayung shall be released on bail of Rs.20,000/- with a surety of like amount to the satisfaction of the arresting authority. 8. The petitioner shall co-operate with the Police Investigating Officer as and when called for. 9. With the aforesaid direction, this pre-arrest bail application stands disposed of.
