In the matter of: Titun Halder ….Petitioner. Mr. Mrityunjoy Chatterjee Mr. Manas Das Ms. Barnali Gupta
…for the petitioner.
Mr. Sanjay Banerjee Mr. Debarshi Brahma
….for the State.
Report filed on behalf of the State is taken on record.
Learned counsel appearing on behalf of the petitioner submits that he has been falsely implicated in this case.
Learned counsel appearing on behalf of the State strongly opposes the prayer for anticipatory bail. However, he submits that the material available against the petitioner is a statements of a police personnel stating that he had heard a co-accused take the petitioner’s name as one of the accused. However, there is no statement of such co-accused implicating the petitioner.
Considering the above, the other materials available in the case diary and the fact that charge sheet has been submitted, I am inclined to grant anticipatory bail to the petitioner.
