W.P.No.34184 of 2026 __________ Page2 of 6 PRAYER : Petition under Article 226 of the Constitution of India, praying for a issuance of writ of mandamus, directing the respondents 1 and 2 to permit to conduct 28th Aadi Thiruvizha on 23.08.2026 and provide necessary police protection for the peaceful conduct of the Aadi Thiruvizha of Arulmigu Sri Mariamman Temple, Parivakkam, and consequently, protect the temple, its properties, devotees and the general public from any unlawful interference. The grievance of the petitioner is that they have been conducting this festival all through the years and suddenly, the private respondents are now objecting to the same. The private respondents are in occupation of the temple properties and are wrongfully restraining the petitioner and others from conducting the festival. Considering the nature of submissions made, this Court suo motu impleads the Assistant Commissioner, HR&CE Department, No.1, C.V.Naidu Road, Jayanagar, Thiruvallur – 602 001, as the sixth respondent in the writ petition as it has already been held that in respect of https://www.mhc.tn.gov.in/judis
W.P.No.34184 of 2026 __________ Page3 of 6 granting permission to temple festival etc., the same cannot be done in the absence of the HR&CE authorities. 3. Mr.C.Chandra Prabu, learned Special Government Pleader, takes notice for the newly impleaded respondent. 4.
It is the contention of the learned counsel for the petitioner that the respondents 3 to 5 are objecting to the same without any right whatsoever and they are only the encroachers of the temple properties and even if they want to conduct the festival, they can conduct on any other day for which the petitioner does not have any objection. In view of the said contention, this Court has to decide the correctness or otherwise of the case of the parties. Since the petitioner wants to conduct the festival on 23.08.2026 and there is no time to issue notice to the respondent 3 to 5 and hear them and then decide the matter, this Writ Petition is disposed of by keeping open all the grounds by giving the relief in the following manner: (i) Let the sixth respondent visit the temple premises tomorrow, i.e., on 22.08.2026 at 10:00 am. (ii) Let the petitioner as well as the respondents 3 to 5 or any other person interested can be present. https://www.mhc.tn.gov.in/judis
W.P.No.34184 of 2026 __________ Page4 of 6 (iii) Let a due enquiry be conducted with reference to the conduct of the Aadi Thiruvizha, i.e., on 23.08.2026. (iv) If the permission has to be granted to the petitioner, let the permission be given and accordingly, the police can grant protection. (v) The entire thing is left to the decision of the sixth respondent by hearing the rights of both sides and then decide the matter. (vi) This Court has not expressed any opinion with reference to the merits or otherwise of the matter that let a decision be taken tomorrow itself, i.e., on 22.08.2026 whether to permit the petitioner to conduct the festival on 23.08.2026 or not and if for any reason, it has to be postponed, the same shall also be intimated in writing to the petitioner. The ultimate decision shall also be intimated in writing to both sides. (vii) The parties shall act upon the web copy of the order, without insisting for the certified copy.
