1. The present bail application has been filed under Section 482 BNSS in connection with FIR No. 2/2025 registered at Police Station C.B.N. D.D.O. Kota for the offence(s) under Sections 8/21, 25(c) of NDPS Act.

Learned counsel for the accused-applicant submits that applicant is a lady aged 48 years, upon whom a notice has been issued dated 07.08.2025 by the respondent-State, wherein she is called upon to help in the investigation. Learned counsel has further submitted that applicant is not arrayed as accused in the instant matter, which is reflected from the notice itself. It is also submitted that applicant has no role to play and there are no criminal antecedents registered against the applicant. Furthermore, it is submitted that applicant is ready to abide by the conditions imposed by this Court. [2026:RJ-JP:12114] (2 of 3) [CRLMB-13785/2025]
3. Per contra, learned Special Public Prosecutor has vehemently opposed the bail application. Learned Special Public Prosecutor has relied upon the judgment of the Apex Court enunciated in the case of The State of Haryana Vs. Samarth Kumar: 2022 LiveLaw (SC) 622. It is submitted that at this nascent stage, no inference can be drawn till the investigation carried out. It is further submitted that if any evidence is found out and hands of the State will be locked and investigation will be hampered. 4. Having heard the arguments advanced by the learned counsel for the parties and considering the fact that accused- applicant is a lady aged 41 years; that applicant has no role to play and there are no criminal antecedents registered against the applicant and looking to the overall facts and circumstances of the case and material on record but without commenting on merits/demerits of the case, this court is inclined to allow the bail application of the accused-applicant. Howsoever, with a caveat that respondents will be at liberty to file bail cancellation application, if the evidences recovered are otherwise. 5. Accordingly, the anticipatory bail application is allowed.
The S.H.O/I.O/Arresting Officer, Police Station C.B.N. D.D.O. Kota in F.I.R. No. 2/2025 is directed that in the event of arrest of the accused-applicant Laxmi Yadav W/o Parmanand, she shall be released on bail, provided she furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:- (i) that the applicant shall make herslef available for interrogation by a police officer as and when
