THE HONOURABLE SRI JUSTICE D RAMESH THE HONOURABLE SRI JUSTICE ALAPATI GIRIDHAR CIVIL MISCELLANEOUS APPEAL NO: 152 of 2013
ORDER: (Per Hon’ble Sri Justice D.Ramesh)
1. The present Civil Miscellaneous Appeal is filed assailing the order dated 16.02.2012 passed in I.A.No.2132 of 2011 in O.S.No.128 of 2011 by the learned IV Additional District Judge, East Godavari District at Kakinada, whereby the Court below granted an order of temporary injunction in favour of the respondent/plaintiff. 2. When the matter was taken up for hearing, there was no representation on behalf of the appellant. 3. The learned counsel appearing for the respondents submitted that, on verification of the e-Courts portal, it is noticed that the suit in O.S.No.128 of 2011 has already been disposed of. 4. Having regard to the said submission, this Court finds that the present appeal arises out of an interlocutory order granting temporary injunction pending disposal of the suit.
Since the main
4
suit itself has already been disposed of, no effective relief survives for consideration in the present appeal. 5. Accordingly, the Civil Miscellaneous Appeal is dismissed as infructuous. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed. _______________________ JUSTICE D.RAMESH
