For Respondent(s): Mr.M.Roshan Atiq, Additional Government Pleader for R1 to R5 ORDER This Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the 4th respondent to consider and dispose of the appeal dated 07.09.2023 filed by the petitioner’s mother. 2. The case of the petitioner is that his mother filed an appeal dated 07.09.2023 before the 4th respondent to cancel the document said to have been fraudulently executed by the 6th respondent in favour of the 7th respondent, which was registered as Doc. No. 3660/2023 dated 01.09.2023. In the meantime, his mother passed away on 23.05.2024. However, the same has not been considered till date. Challenging the inaction on the part of the 4th respondent, the petitioner, being the legal heir, is constrained to file the present Writ Petition. https://www.mhc.tn.gov.in/judis WP No. 31024 of 2026 __________ Page3 of 5 3. In response, Mr. M. Roshan Atiq, learned Additional Government Pleader appearing for the respondents, submitted that the appeal filed by the petitioner’s mother dated 07.09.2023 would be considered by the 4th respondent and appropriate orders would be passed thereon, in accordance with law, within a period of eight weeks. 4. Considering the facts and circumstances of the case and the submissions made on either side, this Court, without expressing any opinion on the merits of the claim made by the petitioner, directs the 4th respondent / Revenue Divisional Officer, to consider and dispose of the appeal dated 07.09.2023 filed by the petitioner's mother, seeking to cancel the registered document, and pass appropriate orders on merits and in accordance with law, after affording an opportunity of hearing to the petitioner, the private respondents, and other interested parties, if any, within a period of eight (8) weeks from the date of receipt of a copy of this order. https://www.mhc.tn.gov.in/judis WP No. 31024 of 2026 __________ Page4 of 5 5.
